"The big intent, in a nutshell, was to control the type of development that would occur in the gateway to Tolland green," said Farmer. She said the plan intends to attract more developers to the area and create a walkable town center, with a mixture of residential and commercial development.
But Stephen Williams, a home developer who owns 13.46 acres of land at 53 Merrow Road, claims in the suit filed at Superior Court in Rockville by his lawyer, Tim Hollister, that the regulations make development more difficult.
Hollister said that at a June 13 meeting the commission "introduced a whole bunch of changes that the public had no notice of." Hollister said that there was no opportunity for the public to review the zoning changes being proposed.
According to Hollister, even though the planning and zoning commission claims that certain design guidelines are only advisory, the commission failed to remove language mentioning the guidelines from a section of the document explaining the process for approval of a proposed development in the village area.
